1. Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and MyLandIQ ("Company," "we," "us," or "our") governing your use of the MyLandIQ mobile application ("App") and related services ("Services").

By creating an account, making a purchase, or using our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms.

2. Eligibility

To use MyLandIQ, you must:

• Be at least 18 years of age
• Have the legal capacity to enter into binding contracts
• Not be prohibited from using the Services under applicable laws
• Provide accurate and complete registration information

3. Description of Services

MyLandIQ provides AI-powered real estate analysis services, including:

• Property Analysis: AI-generated development recommendations based on property details
• Market Insights: Location-based market analysis and valuations
• Financial Projections: Estimated costs, revenues, and ROI calculations
• Development Options: Multiple development scenarios ranked by feasibility

4. Account Registration

4.1 Account Creation

To access our Services, you must create an account using:

• Google Sign-In, or
• Email and password registration

4.2 Account Security

You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized access

5. Credits and Payment

5.1 Credit System

MyLandIQ operates on a credit-based system:

• Each property analysis consumes 1 credit
• Credits can be purchased through the App via Google Play
• Credits do not expire and are non-transferable

5.2 Pricing

Current credit pricing (subject to change):

• 1 Credit: ₹99
• 5 Credits: ₹399 (20% savings)
• 15 Credits: ₹999 (35% savings)

All prices are inclusive of applicable taxes (GST).

5.3 Payment Processing

All payments are processed through Google Play. By making a purchase, you also agree to Google Play's terms of service.

6. Refund Policy

Please refer to our detailed Refund Policy. In summary:

• Unused credits may be refunded within 7 days of purchase
• No refunds for credits that have been used
• Technical issues may qualify for credit restoration or refund

7. Acceptable Use

7.1 Permitted Use

You may use MyLandIQ for:

• Personal property research and analysis
• Professional real estate consultation (for your clients)
• Investment decision support
• Educational purposes

7.2 Prohibited Activities

You agree NOT to:

• Reverse engineer, decompile, or disassemble the App
• Attempt to gain unauthorized access to our systems
• Use automated scripts or bots to access the Services
• Share your account credentials with others
• Use the Services for any illegal purpose
• Resell or redistribute analysis results commercially without permission
• Submit false or misleading property information
• Interfere with or disrupt the Services

8. Intellectual Property

8.1 Our Rights

MyLandIQ and its licensors own all rights to:

• The App and its underlying technology
• Our trademarks, logos, and branding
• AI models and analysis algorithms
• Website content and documentation

8.2 Your Rights

You retain ownership of:

• Property information you provide
• Analysis results generated for your use

You grant us a limited license to process your property data solely for providing the Services.

9. Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Accuracy, completeness, or reliability of analysis results
• Fitness for a particular purpose
• Non-infringement of third-party rights
• Uninterrupted or error-free operation

9.1 AI Limitations

You acknowledge that:

• AI-generated analysis may contain errors or inaccuracies
• Market conditions change and past data may not predict future results
• Our recommendations do not guarantee investment success
• You should consult qualified professionals before making decisions

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• MyLandIQ shall not be liable for any indirect, incidental, special, consequential, or punitive damages
• Our total liability shall not exceed the amount you paid for credits in the 12 months preceding the claim
• We are not liable for any decisions made based on our analysis
• We are not responsible for third-party services (Google, Firebase, etc.)

11. Indemnification

You agree to indemnify and hold harmless MyLandIQ, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from:

• Your use of the Services
• Your violation of these Terms
• Your violation of any third-party rights
• Any decisions you make based on our analysis

12. Account Termination

12.1 Termination by You

You may delete your account at any time through:

• App Settings → Delete Account
• Emailing support@mylandiq.com

12.2 Termination by Us

We may suspend or terminate your account if you:

• Violate these Terms
• Engage in fraudulent activity
• Abuse our Services or other users

12.3 Effect of Termination

Upon termination:

• Your access to the Services will be revoked
• Unused credits are forfeited (unless termination is by us without cause)
• Your data will be deleted per our Privacy Policy

13. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes through:

• In-app notifications
• Email to your registered address
• Updated "Last Updated" date

Continued use after changes constitutes acceptance of the new Terms.

14. Governing Law and Disputes

14.1 Governing Law

These Terms are governed by the laws of India, without regard to conflict of law principles.

14.2 Jurisdiction

Any disputes shall be subject to the exclusive jurisdiction of the courts in Ludhiana, Punjab, India.

14.3 Dispute Resolution

Before filing any legal claim, you agree to attempt to resolve the dispute informally by contacting us at legal@mylandiq.com. We will try to resolve the dispute within 30 days.

15. General Provisions

• Entire Agreement: These Terms constitute the entire agreement between you and MyLandIQ
• Severability: If any provision is found invalid, the remaining provisions remain in effect
• Waiver: Failure to enforce any right does not constitute a waiver
• Assignment: You may not assign these Terms; we may assign them freely
• Force Majeure: We are not liable for delays due to circumstances beyond our control
